Social Media and Personal Injury Cases

Not surprisingly, that has also had a significant effect on personal injury litigation.

Clients frequently use social media to comment on accidents, their injuries, and their post-accident activities.

While these comments may seem innocent and irrelevant, parties need to be aware that these comments may be deemed an admission and can be used against them at later stages of litigation. As such, social media and litigation have become closely intertwined. (more…)

Adam T. Mandell, Esq. Named Partner

ATM COLOR PHOTOAdam T. Mandell, Esq., of Palenville, New York, was named a partner of Maynard, O’Connor, Smith & Catalinotto, LLP, effective January 1, 2015.

Adam joined the firm as an associated attorney in 2008 and has successfully represented individuals, businesses and municipal entities in State and Federal Courts. He primarily practices in the firm’s Saugerties Office, with a concentration in the areas of personal injury, wrongful death, medical malpractice, commercial matters and complex litigation. He also devotes a portion of his practice to appellate advocacy.

Adam graduated from Hobart College in 2001. He attended Western New England College School of Law, where he earned his J.D. in 2006, cum laude.

Adam is a Delegate to the New York State Bar Association (NYSBA) House of Delegates, a Board Member of the Ulster County Bar Association, and serves on the Committee for Character and Fitness for the Third Judicial District. He was also selected to be included in the 2014 listing of Super Lawyers Rising Stars.

Adam lives in the Catskills with his wife and son. Adam enjoys spending time outdoors, hiking and biking with his family in the Catskills and the Hudson Valley.

Rob Rausch recently presented a lecture at Albany Law School, in conjunction with the school’s program to provide free Continuing Legal Education credit to recent graduates. Rob presented on the topics of “The Purpose, Procedure, and Strategy of Discovery”, and “Guidelines and Recommendations for Depositions”, and discussed procedures and advice for successfully handling for personal injury litigation. Rob is a graduate of Albany Law School and is currently President-elect of the National Alumni Association.

Firm Successful in Representation of Injured Motorcyclist

Concetta Lomanto recently helped a client obtain a pre-suit settlement to compensate him for injuries resulting from a motorcycle accident. The accident arose when another driver made an illegal left-hand turn directly into the motorcyclist’s path. The client suffered serious injuries, including a rotator cuff tear, which ultimately required arthroscopic surgery, the complication of a “frozen shoulder”, a long recovery period, and permanent limitations and restrictions. Following a thorough investigation and negotiations with the other driver’s carrier, Concetta was able to successfully obtain a significant settlement, without the need to place the case into litigation.
