Successful Settlement Follows Severe Food Allergy Personal Injury Case
The plaintiff in the case had a long-standing severe allergy to nuts. Although she specifically advised the waiter of the allergy, and asked whether the food contained nuts, the waiter failed to take appropriate steps to determine the food’s ingredients, and assured her that it did not.
Unfortunately, the appetizer did indeed contain crushed walnuts, which are recognized to be among the more dangerous foods to those who suffer from nut allergies. Within moments of ingesting the food, the plaintiff sustained a severe allergic reaction and experienced difficultly breathing. She was rushed to a nearby hospital for treatment.
To compound matters, at the time of the exposure, the plaintiff was in the early stages of a pregnancy, which required very cautious medical intervention to protect the lives of both the plaintiff and her unborn child. Luckily, the baby was not affected by the exposure and medication, and was ultimately delivered without harm.
